Pulwama attack case: Pulwama attack accused Insha Jan's bail plea rejected

  A special NIA court here has rejected the bail plea of ​​Insha Jan alias Insha Tariq, an accused in the 2019 Pulwama suicide attack, in which 40 CRPF personnel were killed. The court said that there is sufficient material on record to prima facie prove the charges against him.

Special Judicial Officer Prem Sagar, in his 15-page order, said that the legal bar under Section 43-D(5) of the Unlawful Activities (Prevention) Act (UAPA) also applies to the accused and prevents his release at this stage.

Jan, a resident of Harkipora village in south Kashmir's Pulwama district, was arrested along with her father Pir Tariq Ahmed Shah in March 2020. The court had framed charges against him on December 10, 2022.

According to the NIA chargesheet, Jaan was allegedly involved in the terror conspiracy and was in constant touch with Pakistani terrorist Mohammad Umar Farooq. He is accused of providing food, shelter and other logistical support to the accused terrorists. Moreover, the video of suicide bomber Adil Ahmed Dar that went viral after the attack was allegedly recorded at his house on January 28 and 29.

The defence had sought bail citing long imprisonment, delay in trial and health condition (skin problem and headache). At the same time, the NIA had strongly opposed bail citing the gravity of the charges and the restrictions of Section 43-D(5) of the UAPA.

The court rejected the arguments of the defence, saying that delay alone cannot be a ground for bail in the present case and the trial is on. The court also said that the health condition of the accused is not life-threatening, although the jail administration has been directed to provide him with all necessary medical care.
