US ends automatic work permit extension for immigrants

  Weeks after raising the H1B visa fee to USD 100,000, US officials have announced the end of the automatic extension of work permits for immigrants. The decision is likely to affect a large number of Indian immigrants and workers. The US Department of Homeland Security (DHS) made the announcement on Wednesday in a series of efforts to tighten immigration.

Proper screening and vetting of immigrants will now be prioritized before extending the validity of employment authorization documents (EADs) of foreign nationals. DHS said in a press release that under the new rule, immigrants who file for renewal of their EADs on or after October 30, 2025, will no longer get automatic extensions. The decision will most likely affect the spouse of an H-1B principal nonimmigrant, the spouse of an L nonimmigrant, the spouse of an E nonimmigrant, and immigrants with refugee or asylee status.

Under the Biden administration’s previous rule, immigrants who timely filed Form I-765 to renew their EAD would receive an automatic extension of 540 days. According to U.S. Census Bureau data, the U.S. was home to about 4.8 million Indian Americans as of 2022. Of these, 66 percent are Indian-American immigrants, while 34 percent are born in the U.S.
